NATIONAL SERVICE DOG MONTH

Observed every September, National Service Dog Month honors the extraordinary working canines that empower individuals with disabilities to lead more independent, fulfilling lives. From guide dogs navigating busy streets for the visually impaired to psychiatric service animals providing grounding support during medical episodes, these highly trained dogs are far more than loyal companions—they are essential healthcare partners. Throughout the month, advocates and community members work to raise public awareness about accessibility rights under the Americans with Disabilities Act (ADA), and to educate communities on proper service dog etiquette. 1. PUBLIC SPACES AND BUILDINGS

Law: The Americans with Disabilities Act (ADA) — Titles II & III 
This is the most common law cited for daily life. It guarantees access to places of public accommodation (restaurants, stores, hotels, theaters, schools, etc.).

• Access Rights: Service animals must be allowed to accompany their handlers in all areas of a facility where the public is allowed to go. 

• "No Pets" Policies: These policies do not apply to service animals. You cannot be denied entry because of a "no pets" sign. 

• No Extra Fees: Businesses cannot charge you a cleaning fee or "pet fee" (though you are liable if your animal causes actual physical damage). 
• Staff Inquiries: Staff may only ask two questions if the disability is not obvious:        - Is the dog a service animal required because of a disability?                                       -What work or task has the dog been trained to perform? 
• Prohibited Actions: Staff cannot ask for documentation/certification, ask about your specific disability, or require the dog to demonstrate its task.

2. Housing and Renting

Law: The Fair Housing Act (FHA) 
This law protects tenants from discrimination by landlords and housing providers.

• Broad Definition: The FHA uses the term "Assistance Animal," which covers both Service Animals (trained) and Emotional Support Animals (ESAs) (untrained comfort). 

• Waiver of Rules: Landlords must make "reasonable accommodations," meaning they must waive "no pet" policies and breed restrictions. 

• Fee Exemption: Landlords cannot charge pet rent, pet deposits, or application fees for the animal. 

• Documentation: Unlike the ADA, landlords can request a letter from a healthcare professional verifying the disability and the need for the animal (unless the disability is visible/obvious).

3. AIR TRAVEL

Law: The Air Carrier Access Act (ACAA) 
This law governs discrimination on commercial flights.

• Cabin Access: Service dogs are permitted to fly in the cabin with their handler at no additional cost. 

• Recent Changes (2021): The DOT updated rules to strictly define a service animal as a dog trained to perform tasks. Emotional Support Animals (ESAs) are no longer protected under this law and are treated as pets (subject to fees and carriers). 

• Documentation: Airlines are allowed to require specific Department of Transportation (DOT) forms attesting to the dog’s health, behavior, and training before the flight (usually 48 hours in advance). ​

​4. Employment & The Workplace 

Law: The ADA — Title I 
This covers discrimination in employment (for employers with 15+ employees).

• Reasonable Accommodation: You have the right to request the presence of your service animal as a "reasonable accommodation" to help you perform your job duties. 
• Interactive Process: Unlike public access (where you just walk in), this usually requires a formal request to HR. The employer can ask for medical documentation and proof of the need for the animal. 

• Broader Scope: In some employment cases, animals that do not meet the strict public-access definition of "service animal" (like ESAs) might still be considered a reasonable accommodation, depending on the specific job and disability. ​

FEDERAL PROGRAMS AND EDUCATION

Law: The Rehabilitation Act of 1973 (Section 504) 
This applies to any program or activity receiving federal financial assistance (e.g., public universities, federal buildings, public housing).

• Protections: It provides protections very similar to the ADA, ensuring no one is excluded from participation in federally funded programs due to their disability or service animal. ​

Even with these laws, you can be legally asked to remove your animal if: 

1. The animal is out of control and you do not take effective action to control it (e.g., barking excessively, lunging).
